Passport Update #15 McNeil v US Department of State & IRS - Appeal Status

As reported in my April 12, 2022 blog post entitled “Passport Update #14 McNeil v US Department of State & IRS - Appellate Brief”, I filed my Opening Brief in the U.S. Court of Appeals for the District of Columbia.

The Appellees’ (Government’s) Brief was due to be filed by May 16, 2022.

On May 6, 2022, however, DoJ attorney Anthony T. Sheehan filed his “Motion by the Appellees for an Extension of Time Within Which to File Their Answering Brief”.

On May 11, 2022, Mark J. Langer, the Clerk for the D.C. Court of Appeals issued an Order on the court’s own motion to suspend the briefing schedule, pending disposition of the Government’s request for an extension of time.

In the meantime, the DoJ changed attorneys, replacing Anthony T. Sheehan with new Lead Counsel, Robert J. Branman on May 19, 2022.

Then, on May 23, 2022, Clerk Langer issued an Order granting the Government’s motion for an extension of time within which to file its answering brief. That brief is now due on June 17, 2022.

My Reply brief is due on July 8, 2022.

I will post an update when I receive and read the Government’s answering brief.
