**NEW LAWSUIT** 20-cv-00329 McNeil v US Department of State

On February 3, 2020, I filed a new lawsuit by mailing my Original Complaint to the Clerk of the U.S. District Court for the District of Columbia.

This is a Freedom of Information Act (FOIA)/Privacy Act suit, filed for the purpose of obtaining a copy of the sworn, signed Notice CP508C provided to the United States Department of State by the Department of Treasury’s IRS certifying that I have a “seriously delinquent tax debt”. I never received that document, as required by 26 U.S.C. §7345.

I refer you to my December 31, 2019 blog entitled “Robert A. McNeil (RAM) Passport Saga” detailing the 18 month ordeal I endured while attempting to obtain the Notice CP508C from the State Department.

After publishing that blog, I received the following additional email responses from the State Department:

Mr. McNeil,

This is in response to your email below regarding the status of FOIA Case Control Number F-2018-06462.

We apologize for the delayed response. The Office of Information Programs and Services’ electronic records system indicates that this request is pending a search of the records of the Office of Passport Services in the Bureau of Consular Affairs. You will be notified of the results of the Department’s search and review efforts in response to this request as soon as that information becomes available.

Please be advised that the Department currently has a backlog of requests. As a result, there is a delay in the processing of FOIA requests.

Your continued patience is appreciated.

On February 14, 2020, I received mail from the Clerk for the U.S. District Court for the District of Columbia containing the stamped copy of my Original Complaint, plus the stamped summonses for the U.S. Department of State, Attorney General William P. Barr and the U.S. Attorney for the District of Columbia, Timothy Shea.

This lawsuit was given Case No. 1:20-cv-329 and was assigned to U.S. District Court Judge John D. Bates.

On February 15, 2020, I mailed the three summonses to the Department of State, AG Barr, and U.S. Attorney Shea.

I expect the Department of Justice to assign an attorney to represent the State Department, which has 60 days to respond to my Complaint. Then, the fun begins.
